Welcome to Monty AI ("we," "our," or "us"), operated at montyai.com. These Terms of Service ("Terms") govern your access to and use of the Monty AI platform, including all content, features, and services offered through our website and applications (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you have the legal capacity to enter into a binding agreement. 3. Subscription Tiers and Billing

Monty AI offers the following subscription tiers:

Billing. Paid subscriptions are billed on a recurring monthly basis. By subscribing to a paid tier, you authorize us to charge your selected payment method at the beginning of each billing cycle. All fees are quoted in US Dollars (USD) and are non-refundable except as required by applicable law.

Cancellation. You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period, after which your account will revert to the Free tier.

Price Changes. We reserve the right to adjust subscription pricing with at least 30 days' prior notice. Price changes will take effect at the start of your next billing cycle following the notice period.

4. AI-Generated Content Disclaimer

The courses, learning materials, quizzes, summaries, and other educational content available through the Service are generated using artificial intelligence technologies. While we strive to provide accurate and helpful content, you acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, omissions, or outdated information.
• Content provided through the Service does not constitute professional, legal, medical, financial, or any other form of certified advice.
• You should independently verify any information obtained through the Service before relying on it for important decisions.
• The Service is intended as a supplementary educational tool and should not be used as a substitute for formal education, professional training, or expert consultation.
• We make no representations or warranties regarding the completeness, reliability, or suitability of AI-generated content for any particular purpose.

5. Intellectual Property

Platform Content

User Content

Generated Course Content

Courses and learning materials generated through the Service using AI are provided for your personal educational use. You may not redistribute, resell, or commercially exploit AI-generated course content without our express written permission.

6. Acceptable Use Policy

You agree not to use the Service to:

• Generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MONTY AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to, use of, or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service, including AI-generated educational content.
• Unauthorized access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Monty AI, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in Ireland, and you consent to the personal jurisdiction of such courts.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Monty AI regarding your use of the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
